I like the nested list comprehension. Also nice use of enumeration. Lines 4 and 5 are repetitious, though, but pragmatic I guess.

And maybe do away with the 'XXX' and 'OOO'. If it weren't for these that code would still run with arbitrary grid sizes. This way, though, you are confined to 3x3. I am thinking of something like all in l (that's the letter 'el') are either 'X' or 'O' or something alon those lines. ;)

That's right! You can make the code work for all (square) boards without many changes. Something like that replacing lines 4 and 5 will work and is just the generalization of the same idea: <pre class='brush: python'>for c in ("X","O"): if list(c*len(b)) in l: return c </pre> It surely can be written shorter and prettier... Thank you for your input! :)
